Javier El-Hage is the chief legal and policy officer at HRF, where he co-leads the organization’s impact litigation and research programs. In 2010, El-Hage authored HRF’s report, “The Facts and the Law Behind the Democratic Crisis of Honduras, 2009-2010,” which contained a section on “[How Should the] OAS Apply the Democracy Clause against a Member State?” The paper established working legal definitions for the terms “coup d’etat” and “erosion of democracy” in the context of the OAS Charter and the Inter-American Democratic Charter’s democracy clause. HRF’s report advocated for OAS Member States to be suspended from the OAS if they turned into authoritarian regimes, and it was extensively quoted by the Honduras Truth and Reconciliation Commission’s 2011 report.
